Truck-Pedestrian Crash- $1,700,000 on behalf of a 42 year-old man who was run over by s semi-tractor as the man stood beside the road while assisting another motorist who crashed in an earlier accident. The victim sustained a number of fractures and internal injuries from which he never fully recovered.
  7. Truck-Pedestrian Crash- $1,536,921 on behalf of a 36 year-old man whose wheel chair was struck by a garbage truck as the man tried to cross a busy road. He used a motorized chair due to pre-existing rheumatoid arthritis. The crash resulted in a hip fracture that required surgery and caused the man to lose additional function.
  8. Traumatic Brain Injury-( Farm-Implement/Automobile Crash) – $1,225,666 on behalf of a 50 year-old female who suffered a severe traumatic brain injury when the vehicle she was operating was struck by a farm sprayer that failed to stop at a rural intersection.
  9. Traumatic Brain Injury- $1,100,000 on behalf of a 26 year-old male whose motorcycle was struck by a left turning automobile operated by a 16 year-old driver.

Auto accidents are the most common source of personal injury lawsuits. When involved in an auto accident, there are two types of potential claims that can be made, no-fault claims and liability claims.

No-Fault Auto Accident Claim

Under Minnesota law, all motor vehicle owners must have no-fault coverage as part of their automobile insurance. With no-fault coverage, insurance is provided either by your insurance company or the insurance company of the car in which you were riding, regardless of who was at fault. Benefits of no-fault coverage may include:

  • Compensation for wage loss
  • Coverage of medical expenses
  • Mileage costs
  • Replacement of vehicle

Liability-Based Auto Accident Claim

If the accident in which you were involved was mainly the fault of someone else, you can seek compensation for medical expenses, pain and suffering, loss earnings, disability and other damages. Additionally, the person who caused the accident may also be liable for intentional or reckless conduct. To make a liability-based auto accident claim you must be able to prove four things:

  1. To prove the other person was at fault
  2. To prove that your injuries are a result of the other person’s actions
  3. You must meet at least one of the following criterion:
    • Prove the existence of a permanent scar or disfigurement
    • Sixty or more days of disability (inability to engage in normal activities)
    • $4,000 or more in medical expenses
    • Permanent Injury
  4. That you have undergone pain and suffering, emotional distress and/or disability, making you eligible to sue for damages.

Statute of Limitations for a Minnesota Auto Accident Claim

Under Minnesota Statute §541.05 subd. 1 (5) you must make a claim for your injuries within six years of the date of the accident.
