Campylobacter Food Poisoning: Lawyer and Lawsuit
Our Minnesota food safety law firm is investigating an outbreak of Campylobacter jejuni that has been associated with a restaurant in Apple Valley, MN. According to the Minnesota Department of Health (MDH), to date there are nine laboratory-confirmed Campylobacter cases associated with the outbreak. Two of these people have been hospitalized.
Those sickened report eating a variety of chicken and non-chicken dishes at the restaurant between February 9-14. An MDH environmental health inspection of the restaurant found that chicken (a well known vehicle for Campylobacter) was being undercooked at times. Multiple routes of possible cross-contamination with raw or undercooked chicken were also observed by health officials.
The Minnesota Department of Health has not released the name of the restaurant.
Campylobacter Food Poisoning Lawsuit: Restaurant Liability
Under our system of law, a restaurant is strictly liable for all injuries and deaths caused by the food they serve. This means that it is not necessary to prove that the restaurant was negligent in how it prepared the food. If a restaurant serves food contaminated with Campylobacter, the restaurant is liable, even if the food was contaminated by a producer or processor before it arrived at the restaurant.
If the restaurant egregiously disregarded the safety of its patrons, there may be grounds for a punitive damages claim.
Finding the actual food-source of the outbreak is not necessary to recover compensation for medical expenses, lost earnings, pain and suffering and other damages.
