An auto insurance claim in Minnesota has two parts:
- Minnesota no-fault insurance benefits from your insurance company

Minnesota No-Fault Auto Insurance Claim
In Minnesota, auto insurance is no-fault, meaning a driver involved in a motor vehicle accident has a right to payments from the driver’s insurance company for basic economic loss, including medical expenses, income loss, replacement services loss and, if the injury causes death, funeral expenses, survivor’s economic loss and survivor’s replacement services loss. Minnesota no-fault auto accident law is found in Minnesota Statutes Sections 65B.41 to 65B.71.
The no-fault auto insurance benefits are paid by your insurer. Unless you purchased additional no-fault coverage, your insurer must “provide for a minimum of $40,000 for loss arising out of the injury of any one person, consisting of: (1) $20,000 for medical expense loss arising out of injury to any one person; and (2) a total of $20,000 for income loss, replacement services loss, funeral expense loss [$2,000 limit], survivor’s economic loss, and survivor’s replacement services loss arising out of the injury to any one person” (Minn. Stat. Sec. 65B.44(a).
Auto Insurance Claim for Pain and Suffering and Amounts Not Covered by No-Fault Insurance
Pain and suffering includes amounts for pain, disability, disfigurement, embarrassment, or emotional distress that an injured person has experienced or will experience in the future due to the negligence of another. In auto accident cases, it is generally an at-fault driver, but it is possible to recover against a construction company that leaves a hazard in the road or does some other negligent thing.
The following are some issues that are taken into account when determining the amount of pain and suffering for a Minnesota auto accident:

St. Cloud Hospital Nurse Linked to Ochrobactrum Anthropi and Klebsiella Oxytoca Infections
St. Cloud Hospital officials have reported that 23 of their patients got infections that may have been caused by a nurse who stole painkillers from IV bags. The hospital immediately suspended the nurse, and a criminal investigation has been started.
According to officials, the IV bags may have been contaminated with Ochrobactrum anthropi and Klebsiella oxytoca.
E. coli in Hazelnuts Sickens 3 in Minnesota
Our Minnesota E. coli attorneys are investigating an outbreak of E. coli O157:H7 in Minnesota that has been associated with eating in-shell hazelnuts (also known as filberts) purchased from bulk bins at retail food stores. Three cases have been identified in Minnesota, three in Wisconsin, and one in Michigan.
In Minnesota, all three cases were male and over 50 years of age. Cases were residents of Hennepin, Redwood, and Stearns counties. Two were hospitalized and have claims against responsible parties for medical expenses, lost wages, pain and suffering and other damages.

The victims of this E. coli outbreak became ill between December 20, 2010, and January 28, 2011. All of the cases have reported eating in-shell hazelnuts from grocery stores. Of these, six purchased them from bulk bins at these stores and the other case reported purchasing similar product in a repacked form. Four of the cases reported purchasing the hazelnuts as part of mixed nuts.
Agriculture agencies in the three states and the California Department of Public Health traced hazelnuts consumed by cases to California producer wholesaler D. DeFranco & Sons. This firm has recalled all hazelnut and mixed nut products distributed from November 2, 2010, to December 22, 2010. Recalled product was shipped to stores in Minnesota, Iowa, Michigan, Montana, North Dakota, South Dakota, and Wisconsin.
